By participating in the Company’s Affiliate Program, you represent that you are in compliance with all applicable laws and regulations.

The following information is provided for educational purposes only, but compliance with these and all other applicable regulations, is a material part of this Agreement.

You (the Affiliate) agree that if You violate any applicable US or International laws, including but not limited to those referenced herein, involving online, email and telephone marketing, that You will be responsible for any related damages or penalties incurred or imposed as a result of such violations and will indemnify and hold harmless the Company for any such damages or penalties incurred or imposed on Company as a result of Your failure to comply with these laws.

A. FTC Regulations, including Endorsement Compliance Requirements and Prohibitions against Unfair or Deceptive Acts or Practices. Affiliate agrees to comply with the Section 5a of the FTC Act, which prohibits unfair or deceptive acts or practices in or affecting commerce.

Affiliate also agrees to comply with Federal Trade Commission 16 CFR Part 255: Guides Concerning the Use of Endorsements and Testimonials in Advertising, which requires, among other criteria, that material connections between advertisers and endorsers be disclosed. This means that Affiliate, if providing an endorsement or assessment of an advertiser (in this case, the Company) must prominently disclose the fact that financial or in-kind compensation is provided from the Company. Affiliate is advised to seek its own legal advice if it requires clarification or further guidance on the requirements of the above laws. Company reserves the right to withhold commission fees and cancel the affiliate relationship should it determine that, in Company’s discretion, the Affiliate is not in compliance with the FTC regulations. For more information (however, not legal advice), visit this Guide:

With this Guide, you can jump right to the section on Affiliates or Network Marketers:

Affiliate further agrees, in accordance with the above regulation, not to make any false or misleading statements regarding Affiliate’s use of or experience with Company’s products or services.

B. U.S. Anti-Spam Laws; including The CAN-SPAM Act. Affiliate agrees to comply with The CAN-SPAM Act, U.S. federal legislation enforced by the Federal Trade Commission. A summary of the rule can be found here in the FTC’s Compliance Guide for Business:

Affiliate agrees that by participating in Company’s Affiliate Program, Affiliate is familiar with The CAN-SPAM Act, has reviewed the materials provided at the above links, and specifically agrees to abide by the following:

  1. Don’t use false or misleading header information. Your “From,” “To,” “Reply-To,” and routing information – including the originating domain name and email address – must be accurate and identify the person or business who initiated the message.
  2. Don’t use deceptive subject lines. The subject line must accurately reflect the content of the message.
  3. Identify the message as an ad. The law gives you a lot of leeway in how to do this, but you must disclose clearly and conspicuously that your message is an advertisement.
  4. Tell recipients where you’re located. Your message must include your valid physical postal address. This can be your current street address, a post office box you’ve registered with the U.S. Postal Service, or a private mailbox you’ve registered with a commercial mail receiving agency established under Postal Service regulations. (Note: This usually shows up in the footer of your email, and is automatically included by most email providers. Please double check that your information is accurate.)
  5. Tell recipients how to opt out of receiving future email from you. EVERY message must include a clear and conspicuous explanation of how the recipient can opt out of getting email from you in the future. Craft the notice in a way that’s easy for an ordinary person to recognize, read, and understand. Creative use of type size, color, and location can improve clarity. Give a return email address or another easy Internet-based way to allow people to communicate their choice to you. You may create a menu to allow a recipient to opt out of certain types of messages, but you must include the option to stop all commercial messages from you. Make sure your spam filter doesn’t block these opt-out requests.
  6. Honor opt-out requests promptly. Any opt-out mechanism you offer must be able to process opt-out requests for at least 30 days after you send your message. You must honor a recipient’s opt-out request within 10 business days. You can’t charge a fee, require the recipient to give you any personally identifying information beyond an email address, or make the recipient take any step other than sending a reply email or visiting a single page on an Internet website as a condition for honoring an opt-out request. Once people have told you they don’t want to receive more messages from you, you can’t sell or transfer their email addresses, even in the form of a mailing list. The only exception is that you may transfer the addresses to a company you’ve hired to help you comply with the CAN-SPAM Act.
  7. Monitor what others are doing on your behalf. The law makes clear that even if you hire another company to handle your email marketing, you can’t contract away your legal responsibility to comply with the law. Both the company whose product is promoted in the message and the company that actually sends the message may be held legally responsible.

C. Telephone Marketing Rule Compliance. If Affiliate intends to use telephone marketing in any manner to perform Affiliate sales or marketing in support of Company’s products or programs covered by this Agreement, Affiliate agrees to get express written permission from Company to do so in advance.

If Affiliate obtains Company’s approval to use telephone marketing, Affiliate agrees to become familiar with and comply in all respects with The Telephone Consumer Protection Act, (a federal law enforced by the FCC), including the materials found here: and

Affiliate also agrees to become familiar with and comply in all respects with The Telemarketing Sales Rule, (a federal law enforced by the FTC), including the materials found here:

D. GDPR Compliant Privacy Policy. Affiliate further represents that it has obtained and implemented on its website a Privacy Policy that is compliant with all U.S. privacy rules and regulations including the Can-Spam Act, the Children’s Online Privacy Protection Act (COPPA), and if Affiliate is advertising to or collecting any data whatsoever from residents of the EU, the General Data Protection Regulation (GDPR).

More information about the GDPR can be found at the following links:
